Collection of Personal Information

When you visit MDS/RAI ADVISOR via mdsadvisor.org website, no personal information—such as your name, address, email address or telephone number —is collected, unless you provide us with that information voluntarily. By giving us such information, you will need to consent by using it in the manner described in this policy.  MDS/RAI ADVISOR will not sell, license, transmit or disclose this information outside of MDS/RAI ADVISOR  unless (a) expressly authorized by you, (b) necessary to enable MDS/RAI ADVISOR contractors or agents to perform certain functions for us, or (c) required or permitted by law. In all cases, we will disclose the information consistent with applicable laws and regulations and we will require the recipient to protect the information and use it only for the purpose it was provided.  You may withdraw your consent at any time by emailing us at info@mdsadvisor.org. We will return or destroy your personal information within five days of receipt of your withdrawal of consent.

 

Cookies

Cookies are small data files that a website you visit may save on your computer or handheld device that usually includes an anonymous unique identifier.   Mdsadvisor.org and those of our Products may use cookies for user authentication, keeping track of your preferences, promotional campaigns, tracking our audience size and traffic patterns, and in certain other cases. We may include small graphic images in our email messages and newsletters to determine whether the messages were opened and the links were viewed.

 

Security

All security on our Website is treated seriously. Where applicable, we undertake security steps, including use of SSL technology, on our back-end systems that store customer account information and to protect data transmissions. GDPR Requests

Wix.com is certified under the EU-US Privacy Shield Framework and the Swiss-US privacy Shield Framework as set forth by the U.S. Department of Commerce, regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, and therefore adheres to the Privacy Shield Principles.  The EU General Data Protection Regulation (GDPR) is a data privacy regulation to protect all EU citizens’ data. It gives our clients, among other requirements, the right to receive or delete all their personal data. MDS/RAI ADVISOR can submit a request to Wix.com on behalf of our clients to: 1. Get a copy of their data or 2. Permanently delete their data.  Clients can submit their GDPR request at info@mdsadvisor.org.  We will process your request within five days of receipt.

What type of information is collected?

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

How is the information collected?

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

Why are such personal information collected?

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;

How does the site store, use, share and disclose the visitors' personal information?

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

How do we communicate with the site visitors?

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. Terms of Sale

 

Authorizing One‐time Online Credit Card Transactions Per Course or Service

By using of this website to pay using credit card for courses offered, you authorize MDS/RAI ADVISOR to charge the debit or credit card and receive the debit or credit card payment processed by Stripe, for the amount on date of transaction. The payment is for MDS 3.0 Training, other MDS-Related Courses or consultation services. You read and understand the policy regarding refunds and cancellations in the Cancellation Policy. You certify that you are an authorized user of the debit or credit card.    You certify you will not dispute the payment with your credit card company, so long as the transaction corresponds to the terms indicated in this web form.

 

A receipt from Stripe will be sent to the email you provided during payment and is the confirmation of payment and class registration.  A separate email from MDS/RAI ADVISOR will also be sent to you within 14 days as courtesy notification of class registration.  

 

MDS/RAI ADVISOR does not store any paper documents containing full credit card numbers.

 

Your billing statement will have the following name(s) listed:  MDS RAI ADVISOR. *For your privacy, we do not recommend mailing your credit card information but it is an option.  Call us instead to get assistance while you register using your device.

CLASS POLICY

MDS/RAI Advisor has the right to refuse business with any unruly, aggravated and disruptive individuals before and during any event.

It is important that attendees are respectful toward fellow attendees and training staff, and that their behaviors not interfere with nor disrupt class activities. Therefore, attendees are expected to adhere to the following rules when attending our courses: 

It is the responsibility of the attendee to read and review the course webpage regarding the course information and policies before registering and paying for the course.

CLASS CODE OF CONDUCT POLICY:

1) Disruptive and inappropriate behavior, comments or actions towards another individual are not allowed while the course is in session.  Be polite and respectful toward others.  

2) Aggravated behavior before and during any event, in any form of communication (phone call, email, text, in-person, etc.) will not be tolerated. 

GENERAL CLASS POLICY:

For In-Person events: 

 

1) During the sign-in time, attendee must provide a valid picture ID with the name matching the name on the roster of paid attendees.  A sign-in sheet must be completed with the attendee's name, title, professional license number, valid email, mailing address, phone number and signature for each day of class.  

2) It is the attendee’s responsibility to notify the instructor in advance of a need for accommodation of a disability.

3) Laptop and tablet computers are allowed for (quiet) note taking.  

4) Turn-off or set to vibrate all phones or alarms.

5)  No videotaping of the course while in session.

For Live Stream events:

1)  No sharing of live stream class link:  There is no sharing of the live stream access link.  If another attendee uses the same link, one will have no record of attendance.  No recorded minutes of attendance means no CE contact hours and no Certificate of Completion, even if the examination was passed.   

2)  It is the attendee’s responsibility to notify the instructor in advance of a need for accommodation of a disability.

 

3)  No videotaping of the course while in session. 

Anyone not in accordance with the Code of Conduct will not be allowed to enter or continue the course as we strive to provide the best possible training accommodations.  The attendee will automatically be banned.

For Individuals Invited to "Sit-In Only":

 

Class policy applies to everyone in the training event, even to those who are "sit-in only".  Individuals invited to "sit-in only" means just that.  No training materials, examination, certificates or contact hours will be provided to you as you are not considered a paid registered attendee of the class you are sitting-in. We are not responsible for your inability to get in the class.  "Sit-in only" may be offered to help a nursing peer in need or as a favor from the goodness of our hearts, is based on seat availability and offering this opportunity is not taken lightly.  Please respect the registered (paid) attendees who will be prioritized.  "Sit-in only" individuals who show any signs of disruption and not in accordance with the class policy will automatically be blocked and banned without warning.  

COURSE MATERIALS POLICY FOR ALL EVENTS:

 

MDS/RAI Advisor is not responsible for replacing or resending files after the course has ended.  Files are made available before and during the course and it is the responsibility of the attendee to open and check the file timely.  (If you lose the file after the training, it is not our responsibility to replace it.  This is the same as receiving a file from your English 101 college professor then a month after finishing the English 101 course, you cannot find the file or cannot open the file:  The institution is not responsible for replacing your lost file or a file you did not open before and during the course.)

MDS 3.0 TRAINING

LIVE STREAM SESSIONS:

RECOMMENDED FOR MDS 3.0 TRAINING:

 

  • Recommended:  At least 1 to 2 months SNF or LTC work experience within the last 5 years in California or any non-case mix states. This is not a requirement but it is a recommendation:  You know yourself best!

  • Decent sleep the night before the event.

RECOMMENDED ATTENDEES: 

LTC Facility, Non-CAH Swing Bed Facility & SNF Interdisciplinary Team (RN, LVN, DSD, SSD, AD, DSS, RD, Rehab Dept., DON, MRD, CNA, BOM, Administrator), MDS-involved staff (MDS Coordinator, MDS Nurse Assistant), Dept. of Health Evaluators, MDS Consultants, MDS Auditors- beginners and experienced, from the Non-Case Mix States such as California.

REQUIREMENT FOR LIVE STREAM EVENT:

  • Dependable internet online connection

  • Working device with working screen and working speaker:  Desktop, laptop, tablet or Smartphone

  • A link to enter the online event. 

TRAINING MATERIALS:

- The printed RAI manual** and other printed training materials will be mailed via Priority Mail or similar alternate delivery service.  A tracking number will be emailed once available and can be tracked in www.usps.com (or an alternate mailing service).  The packages are mailed starting the 3rd week before the training. If materials are still available, the last day to mail the materials is 7 days before the training event.  MDS/RAI Advisor is not responsible for a package replacement if the USPS (or alternate mailing service) returns that package to us after the exact address used on the package was the same address provided during registration (i.e., the mailing address provided is incorrect, valid or not) or if the recipient is not available to sign for the package upon delivery causing the package to be returned to MDS/RAI Advisor.  In this case, digital copies will be emailed to that attendee or be made available for download during the live stream event.

- Digital copies of the training material and extra files an MDS nurse should be aware of will be sent by mail in a flash drive or by email:

If by mail:  The flash drive is provided for the attendee's own use, at the attendee's own leisure.  Therefore, attendees are instructed to check the flash drive to make sure it works upon receipt.  Replacement of the files will be made available only if supply is still available before the training event.  We do not send replacements of the flash drives as it can easily get corrupted, i.e., if ejected the wrong way.  Some facility's computers are restricted from using certain websites or other hardware to prevent employees gambling online or to prevent malware; therefore, you should know that the flash drive may not work with your work computers.  (At this point, you need to think of other alternatives because we do not know who you are and what you own.)

If by email:  This option is available only if there is no flash drive in stock or if the flash drive received by the attendee did not have files or the attendee was unable to open the files after arrival in the mail and after being checked using different devices.  The attendee's email provided during registration will be sent the digital copies that would have been in the flash drive.  This option is not available during and after the training event because the attendee would have and should have checked the flash drive beforehand as instructed. 

- Slides will be emailed as a pdf file during the week of the event and it is up to the attendee to print their own copy the way they want their slides printed.  

- Course Evaluations & Examination:   Information will be emailed during the week of the event.  

Training materials will also be available as digital format during the live stream training event.

The week of the event, the following will be emailed to you:

1) Slides (pdf file)

2) Test site online access

An invitation to take the test in an online test site, will be provided the week of the event.  The online examination will need to be completed (passed with at least a 70% score, maximum of 3 attempts) by 11:59pm on day 3 of the course.  After completion of the 3-day training and passing the examination, a digital copy of the Certificate of Completion will be emailed on the next business day.  The hardcopy Certificate of Completion with contact hours will be mailed within 7 days. 

No additional test time will be given for those who do not follow instructions regarding the online test site.

 

If, after the training ends, the attendee has problems such as opening an account in the online test site (which should have been done on day 1) or has problems remembering their account information in the online test site, no additional time is given.  MDS/RAI Advisor is not responsible for providing assistance after hours since assistance is offered and explained multiple times during the training event.

**To lessen paper waste and keep the course fee as low as possible, the printed RAI manual includes all 6 chapters except the appendices.  The digital copy of the RAI manual includes the appendices.

A small token of our appreciation may or may not be included in the training package. Small prizes may be sent by mail for attendee participation.  Unfortunately, no replacements can be made if prizes inadvertently become damaged or lost during transit.

 

IN-PERSON SESSIONS (N/A at this time):

RECOMMENDED FOR MDS 3.0 TRAINING:

- If using a device during the in-person sessions, it is your responsibility to download and test any file (such as the slides pdf file or the RAI manual digital file) on your device (ie, ipad, iphone, laptop) before coming to the training event.  We cannot assist you with opening your files during the training. 

 

- Bring your own charger.  Charging ports will be made available in the training room.

- Training materials will not be available as digital format during the in-person event.

- A small token of our appreciation may or may not be included in the training package. Small prizes may be presented for attendee participation.  Unfortunately, no replacements can be made if it inadvertently becomes damaged.

COMPETENCY COURSES (Self-study/Self-review.  Online event.):

RECOMMENDED ATTENDEES:

Any MDS-involved IDT members who need the following:

  • Update personnel file

  • Show proof of completing a course regarding RAI (MDS) updates within the past 2 years

  • Practice RAI-related skills

  • Show evidence of MDS competency

  • On-boarding test for new MDS-involved staff for possible hire

(Current scheduled dates are for MDS nurses.  Social Services, Activity and Dietary Departments will have separate dates soon but if you are well-versed with the MDS, you are welcome to take the course!)

This course is not for beginners.

REQUIREMENT:

  • Dependable internet online connection.

  • Working device with working screen:  Desktop, laptop, tablet or Smartphone.

  • An invitation link to enter the online testing site for the chosen Competency Course date.

  • Complete the course and pass the examination with 80% score (maximum 3 attempts) by 11:59pm of the 3rd day of the Competency Course date.

Updates or revisions of the RAI manual within the past 2 years, the RAI manual and the MDS Assessment Form are provided in the course as reference materials.  All are in digital format and are available within the course.  There is no need to purchase these separately.

MDS 3.0 TRAINING LIVE STREAM 

IMPORTANT INSTRUCTIONS:

- We are not responsible for the attendee's inability to get in the class (or on time) for the following:

1) The attendee cannot find the link because they did not read their multiple emails that include the link repeatedly. 

2) The attendee did not check the link upon receiving the emails.  All links are working links auto-generated by Demio.  

3) The attendee's device is not working during the event date.

Links that work on our end using different devices mean something is wrong with your device.  Thus, do not wait until the last minute to check. Calling us last minute to assist with the links will cause further delay. 

4) "Work" or "Company" email used during registration and the attendee does not have access at home:  We are not responsible for your ability or inability to access your emails.  It is your responsibility to get those MDS training information with you wherever you are doing the live stream.  

5) Internet is slow or device battery ran out:  Please do not message or call regarding this as we definitely cannot help. Other people using the same internet to play video games or watch youtube can slow down your connection.  Multiple windows open in your device may cause connection issues and may need to be closed.  Note down the last slide or MDS item covered. If a large section was missed, additional 30 minutes are provided each day to review missed areas.  

- Sessions are Pacific Time (PT).  Depending on the time of the year, PT can be PST or PDT.

- Do not drive to our office or former training location.  Live Stream is a live, online event.  

- The sessions are not recordings.  There is no rewind button. 

 

CHECK THE FOLLOWING UPON RECEIPT OF ACCESS LINK:

STEP A:

- CLICK on the unique link provided in your email to see if it works.  (You should see a countdown.)  Demio is the live stream platform we will be using.   No need to download an app.  Any updated device should work so you can move on to STEP B.  

In case the link does not work, here are some things you may need to do to check your device:

1. Clear your cache.  Go to your computer settings and clear your browser cache history.

2. Check your browser.  Desktop minimum version requirements for each browser:  Chrome 55+, Firefox 53+, Safari 12.1+, Edge 42.  Mobile browsers: iOS and Android OS.  Don't know your browser?  Click here. For instructions on how to update your browser, visit your browser's help pages. We recommend using one of these browsers:

3.  Call us if none of the above worked.

STEP B:

Use a device with the following (This is a requirement!):

1.  Working speakers (If none, plug-in headphones or portable speakers.)

2.  Working screen 

3.  Dependable internet connection

- Use a device with a working screen, working audio and dependable internet connection.  If you have internet that keeps logging you out, then it is not a "dependable internet connection".  Solutions:  Find another device, call your internet provider.

- Check if you can hear out of your device, meaning- it has speakers that work.  If not, here are some solutions:  Get plug-in headphones or portable speakers.

- You need to be familiar with your own device and know how it works. 

  • We cannot give you orientation as to how you can change the volume setting of your device.  Devices may have multiple volume settings.

  • If you do not have the 3 device requirements, please avail these before the session; otherwise, do not take the live stream course. 

- If none of the above helped, then you do not have the requirements, i.e., you do not have a working device or a dependable internet.   Call us to cancel the course timely to get the refund.   If you call us too late and you notice these issues during the training, then there is no refund.

STEP C:

- Find & set up your quiet area with minimal distraction and with a dependable, working internet connection.  

- If available, have a back-up device such as an extra tablet, smartphone or laptop and practice using the unique link on it.

 

DURING DAY OF EVENT:

- Open your device and make sure it is fully charged or plugged-in.  (Smartphones can be used- you may need to swipe left or right to see the slides, instructor or chat room.)

- Use the unique event access link provided by Demio to get in the "room".

- Click on link or copy/paste to your browser to get in the "room".

- Count down should be showing if it is before the start time.

- Web live stream "room" will open 7:30am (Pacific Time) for the morning sessions and 12:45pm (Pacific Time) for the afternoon sessions.

- Audio issues?  Slides are not 'moving'?  Try these steps:

  1.  Refresh the page. 

  2.  Log out or close the window and log back in.

  3.  Check your device volume settings.  It usually has multiple audio settings.

OTHER TYPES OF CANCELLATION:  

 

MDS/RAI ADVISOR MAY CANCEL ATTENDANCE OF ATTENDEE WHEN THE FOLLOWING OCCURS:

 

1) Attendee calls to have a seat saved but PAYMENT BY CHECK IN THE MAIL NOT RECEIVED 7 BUSINESS DAYS BEFORE EVENT: Attendee name will be removed from attendance roster until payment is received. MDS/RAI Advisor is not responsible for late or lost mail.  Reason:  Training venues charges for final head count a week before the event.

 

2)  Problem arises with business check payment.

​3)  Disputes for refunds where the dispute is won by MDS/RAI Advisor against the customer's credit card company or bank:  To prevent future disputes, the customer who does not understand or read the cancellation and refund policies will not be allowed to attend any future courses.

 

RETURNED CHECKS/BOUNCED CHECKS POLICY:

 

Due to the issues regarding payment by personal check, it is MDS/RAI ADVISOR’s policy not to accept personal checks as a form of payment for the courses.  Business checks, cashier's check and/or money orders are accepted.

 

POLICY: To establish an effective method of dealing with returned/bounced checks.  (The term "checks" refers to business checks from hereon.  If special agreement between attendee and MDS/RAI Advisor regarding a personal check as payment, the term "checks" will also apply to personal checks.)

PURPOSE: To ensure all returned and bounced checks are handled with uniformity.

PROCEDURE:

1. Payment to MDS/RAI ADVISOR is expected to be paid in a responsible and timely manner. However, there may be occasion, when and if received checks (from facility administrator or representative sponsoring attendee(s) for the MDS training/courses) may have returned by the bank for insufficient funds or bounced due to the account being closed.

 

2. Returned Check Policy: a) All returned checks will incur a minimum of $30.00 in Returned Check Charges. b) Any checks returned for insufficient funds will not be re-deposited. c) A letter will be sent out with a copy of the returned check notice to the sponsoring facility administrator or representative.  d) The letter will clearly state the additional $30.00 fee will be added to the original amount owed. The letter will advise the sponsoring facility representative that their name will now be placed on a Bounced Check Checklist and that they will have to now pay for seat by credit card.  e) No post-dated checks will be accepted.  

 

3.  Disputing a Returned Check:  If the bank is at fault, a letter must be submitted as follows: a) The letter must be on original bank letterhead paper. b) The letter must state that the BANK made an error that caused the check to be returned. Upon receipt of a bank letter, we will re-deposit the original check, if the customer so desires, and any related charges will be waived.

 

4.  Due to the above concerns, it is MDS/RAI ADVISOR’s policy not to accept personal checks as a form of payment for the courses offered.  Business checks, cashier's checks and/or money orders are accepted.

 

CANCELLATION OF FACILITY VISITS AND IN-HOUSE FACILITY TRAINING:

 

Cancellation of facility visits and/or in-house facility training are specified in the contract between MDS/RAI Advisor and Facility and/or Facility Representative.

CERTIFICATE OF COMPLETION AND REPLACEMENT: 

MDS 3.0 TRAINING, PDPM TRAINING, MDS REFRESHER-

In-Person Events:  Certificate of Completion will be awarded if 70% of the examination answers are correct and attendee signed the attendance rosters for all sessions.  If less than 70% after the third attempt and/or if signature(s) is/are missing in the attendance roster(s), the Certificate of Completion will not be awarded.  The official hard copy of the certificate will be distributed at the end of the final day, after test is passed and evaluation are turned in.  Digital copy will be emailed within a week.

Live Stream Events:  Certification of Completion will be awarded if 70% of the examination answers are correct and course attendance must show 13 class hours (includes participation in the attendee's online engagement during Q&A or polls sections of the course).  A temporary digital copy of the Certificate of Completion will be provided via email after test and evaluation are turned in or completed via Certcentral.com (only until July 2021). The official hard copy of the certificate will be mailed within a week after passing the examination.   

For licensed nurses, the Certificate of Completion will have both the name of the RN or LVN matching with the license numbers as posted online by the State Board of Nursing records at the time of training event.  Only one Certificate of Completion will be provided (either digitally or paper format) for one Designation or Title will be provided at the end of the 2-day, 3-day or 1-day course.  For example, if an attendee has both RN and LVN licenses, the attendee's license upon registering for the course is for the RN license, then the RN license information will be on the Certificate of Completion and no additional certificates will be printed or digitally made with the LVN license information. 

 

Correction request of information that was provided during registration after the Certificate of Completion has been mailed or printed is a request for replacement. Requests for corrections may take up to 7 days.  Requests for replacement of Certificate of Completion can be emailed with attendee name, training date and phone number to info@mdsadvisor.org.  Once verified via the "Sign-In Sheet" that requester has attended the training, an invoice will be emailed back for $20 service fee.  The invoice has a "Pay Now" button for instant credit card payment.  A digital copy of the Certificate of Completion will be emailed to requester (attendee) within 72 hours of receipt of payment.  No refunds will be provided due to digital format is sent via email.  Note:  If original format provided was digital format, the replacement may be a paper format.  Only one format is allowed for the replacement. COMPETENCY COURSE (Self-study/Self-review)-

 

Complete the Course Sections and pass the Examination with at least a 80% score by 11:59pm of the 3rd day of the Competency Course to avail the CERTIFICATE OF COMPLETION.  Afterwards, there will be no access to the course and exam.  If you are unable to complete the course and are unable to pass the examination (maximum of 3 attempts) by 11:59pm of the 3rd day of the course, at the latest, then the Certificate of Completion will not be awarded.  (In this case, the course will need to be re-taken.)  If you are able to complete the course and pass the examination by the required time, then you have successfully earned the Certificate of Completion!  Print your Certificate of Completion after passing the examination & add to your personnel file!  Note:  Continuing education contact hours are not included in the Certificate of Completion at this time.

CONTINUING EDUCATION CONTACT HOURS:

MDS 3.0 Training-

Continuing education contact hours will be awarded to attendees who pass the examination by 11:59pm of the 3rd and final day of the MDS 3.0 Training if record shows at least 13 hours of attendance.  Full or partial continuing education contact hours cannot be awarded for attendance of less than 13 hours.  If unable to pass the exam after the third attempt, Certificate of Completion cannot be awarded.  

Refresher & PDPM Training-

Continuing education contact hours will be awarded to attendees who pass the examination by 11:59pm of the event if record shows the specified hours of attendance has reached the specified contact hours of the event.  Full or partial continuing education contact hours cannot be awarded for attendance less than the specified contact hours.  If unable to pass the exam after the third attempt, Certificate of Completion cannot be awarded.
